Lawsuit Filed Against Tennessee Prison After Woman Miscarries

A woman in Nashville, Tennessee, has filed a lawsuit against the state in Davidson County Circuit Court claiming prison staff at Metro’s Correctional Development Center was responsible for the miscarriage of her child. According to The Tennessean, the multimillion-dollar lawsuit alleges constitutional violations, negligence, medical malpractice, wrongful death and other claims.
In November 2010, records show that the woman was taken to the detention center after she was charged with a probation violation for having alcohol in her system when tested. She suspected she was pregnant, but when given a test, it came back negative. The next day, she says prison staff refused several medical request including taking another pregnancy test. Within hours of the refusal, she began having terrible abdominal pains and miscarried into a prison toilet. She was taken to Nashville General Hospital for treatment.
Medical staff requested that the fetus be saved, but it was destroyed in the removal process.
While a lack of physical evidence and reasoning as to why the woman was drinking before a court appearance if she suspected she was pregnant make this case difficult, Metro Department of Corrections has had a history of lawsuits involving the treatment of pregnant prisoners in their care. In August, a woman received a $200,000 settlement after claiming her rights were violated when she was shackled while giving birth.
